Term of Use

These Terms & Conditions (“Terms”) constitute a legally binding agreement between Brainwave Solutions, trading as RocketHost.cy (“RocketHost”, “we”, “our”, or “us”) and the subscriber (“Client”, “you”, or “your”). These Terms govern your access to and use of all RocketHost.cy hosting services and incorporate by reference the Acceptable Use Policy, Backup & Disaster Recovery Policy, and Privacy Policy.

30-Day Satisfaction Guarantee & One-Year Commitment

We value long-term relationships with our clients because they align our interests—we’re committed to supporting your ongoing growth and success. While our initial setup and optimization process is both time-intensive and detailed, we do not charge any setup fees. For this reason, all our plans require a one-year minimum commitment.

New clients may cancel within the first 30 days of their initial one-year term and receive a full refund by emailing us at team@rockethost.cy.

When a purchase is made, a user account is automatically created to facilitate service delivery and account management. This account will contain the personal details you provide, excluding your password. All passwords are stored in encrypted form and are not accessible to our staff.

Subscriptions will renew automatically according to the selected payment schedule until cancelled. You may request cancellation at any time, and no further charges will apply for future periods. Please note that payments made after the initial 30 days are non-refundable. If you are within the one-year commitment period, you remain responsible for payments for the remainder of the term.

Payments

You will be billed according to the payment plan you select, with options for yearly or 6-monthly billing. Fourteen (14) days prior to the due date, we will issue an invoice. If payment is not received within 14 days, your plan will be cancelled. Please note that reactivation of a cancelled plan may be subject to additional charges.

Limitation of Liability

We provide these subscription services on a best-effort basis and will make every reasonable attempt to deliver the services as described. However, no system or service is flawless, and issues may arise (for example: backups may fail or be unavailable, your site may be compromised beyond repair, downtime may occur, or we may be temporarily unreachable).

If such issues occur, we will make every reasonable effort to resolve them as quickly as possible. You agree that our liability is limited to the total fees you have paid us for the service. Under no circumstances shall we be held liable for any lost profits, lost savings, loss of data, or any incidental, indirect, special, or consequential damages arising from the use of our services or from any breach of this agreement.

WordPress Updates

Keeping your site’s software up to date is essential for security, as outdated software is the most common cause of compromised websites.
We typically do not apply updates immediately upon release (unless it is a critical security patch), since updates can sometimes introduce new bugs. In some cases, WordPress core, theme, or plugin updates may conflict with other plugins or themes installed on your site.

While we are not responsible for any issues that may result from such updates, we will make every effort to identify problems and assist in resolving them, including restoring your site from a backup if needed.

Theme updates will be applied for minor (“point”) releases, but generally not for major version releases.

Intellectual Property

Unless otherwise stated, we retain all intellectual property rights to the content we create, including but not limited to our knowledge base, which is made available to you as a customer. This material is provided solely for your personal use in connection with our services and may not be shared, reproduced, or distributed to any third party without our prior written consent.

Right to Terminate Services

To protect ROCKETHOST.CY and the clients we serve, we reserve the right to discontinue services for any client who violates our policies or terms. You may not use our services in any manner that causes harm to our website, our services, other customers, or the property of third parties.

We may terminate our agreement to provide services at any time, at our sole discretion. In such cases, we shall not be liable for any damages arising from the termination. However, we will refund any amounts already paid for services not yet rendered as of the termination date.

Third-Party Recommendations

From time to time, we may recommend plugins, tools, or other materials developed by third parties. Any such recommendations are provided solely for your convenience. We do not control, endorse, or assume responsibility for third-party products, services, or content, and we shall not be held liable for any issues arising from their use. You are responsible for conducting your own research to determine whether a third-party provider is the right fit for your needs.

Consent to Electronic Communications

By completing your purchase, you agree to receive electronic communications from us, including any required legal notices. We will send such communications to the email address you provided during your purchase.

Disclaimer of Warranties

Our services are provided on an “as is” basis. We make no representations or warranties, express or implied, regarding the performance, reliability, or suitability of our services for your needs. We cannot guarantee that our services will meet your requirements or that our website and services will be uninterrupted or error-free.

We are not responsible for any loss of content, data, or materials provided to us as part of the services.

Incorporated Policies

By purchasing, subscribing to, renewing or using any RocketHost.cy service, you acknowledge that you have read, understood and agree to be bound not only by these Terms & Conditions, but also by the following policies, which form an integral part of this Agreement:

These policies are incorporated into these Terms by reference and are legally binding to the same extent as these Terms & Conditions. In the event of any conflict between these Terms and any of the above policies, these Terms shall prevail unless expressly stated otherwise.

Legal Terms and Governing Law

Although written in plain language, this agreement is legally binding and governed by the laws of the State of California. Any disputes shall be subject to the exclusive jurisdiction of the courts of Los Angeles County, California.
